Tester’s Agreement
March 16, 2010 posted by David Leite
1. I have read the Recipe Tester Overview, and I understand all that is involved with the testing process. I attest that I am 18 years of age or older. I acknowledge and understand that testing recipes, by its nature, can entail risks which may result in injury to myself or to others, or damage to property, or both. I agree to accept and assume all risks associated with testing recipes for Leite’s Culinaria. My participation as a tester in the tester group is purely voluntary; I choose to participate regardless of any potential risks.
2. I agree and voluntarily release, forever discharge, and agree to indemnify and hold harmless Leite’s Culinaria from any and all claims, demands, or causes of action, which are in any way connected with my participation with the site. Further, should it become necessary for Leite’s Culinaria to incur fees, legal or otherwise, and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
3. By participating as a tester for Leite’s Culinaria, I acknowledge that I have waived my right to maintain a lawsuit against Leite’s Culinaria, its employees, representatives, agents or assigns, on the basis of any claim from which I release them herein.
4. I agree to test at least one dish every session (approximately one dish a month), but I can test more if I wish.
5. I understand that Leite’s Culinaria testing group includes all types of cooks–from home cooks to professional chefs–and that my experience and input is important to the proper evaluation of each recipe.
6. After testing each recipe I will fill out the evaluation form (located on the private testers’ homepage) to the best of my ability. I understand that the posting of my review on the site is the sole discretion of David Leite and Linda Avery.
7. I will follow each recipe as closely as possible, allowing for no substitutions or “freelancing.” This is crucial for accurate results and evaluations.
8. I understand that if I don’t test recipes for three consecutive months or if I test recipes inconsistently for six months, I will be asked to leave the testing group. When I’m able to fulfill the minimum requirements of testing of one recipe per session, I can request being reinstated in the testing group.
9. I will not contact any cookbook author or writer directly on behalf of Leite’s Culinaria. If I have a question about any recipe, I will contact the proper Leite’s Culinaria editor.
10. Once I have accepted these rules, I will receive an e-mail that will contain the password to the private testers’ homepage. I agree to maintain the confidentiality of this password and will not share them with anyone.
11. If I have a blog or Web site, I agree not to include the recipe(s) because I do not have permission to do so. Permission to post the recipe(s) on Leite’s Culinaria is granted exclusively by the publisher to Leite’s Culinaria. I can, however, write about my experience of testing dishes, mentioning the names of recipes, authors, and Leite’s Culinaria.
12. I agree to add my name (subscribe) to Leite’s Culinaria, and I realize my information will be for use on this site only. It will remain private and will never be traded, sold, or transferred.
13. I agree that I cannot list my recipe-testing experience for Leite’s Culinaria on my resume for prospective employment UNLESS I have completed 12 months of testing at least one recipe a month or completed six months of testing at least two recipes a month. I understand that if haven’t met the above requirements and a prospective employer contacts Leite’s Culinaria for a reference, Leite’s Culinaria is not obligated to provide it.
